Privacy Policy

BIRD MOIS (“we”, “us”, “our”) takes privacy seriously, whether you're enquiring about a course, sitting down with one of our coaches, or just browsing the
website. This Policy explains, in plain terms, what personal information we collect, why we collect it, what we do with it, and how you can get in touch if you want to see, correct, or ask questions about your information.

It's written with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth) and the Spam Act 2003 (Cth) in mind, but our aim is for it to actually
make sense to a person reading it, not just tick a legal box.

What We Collect

The types of personal information we may collect about you include:

• Depending on how you deal with us, we might hold:
  • Your name, email, phone number, and business or organisation name
  • Details about the course or certification you're interested in, your career background, and notes from coaching sessions
  • Payment details — handled by our payment provider, so we don't hold your full card information ourselves
  • Whether you're subscribed to our newsletter and a record of what we've sent you
  • Basic website analytics, such as browser type and pages viewed
  • Contact details you've handed us in person like a business card at a conference, an introduction at a networking event etc

We may collect these types of personal information directly from you or from third parties. who are partnering with us to refer you as clients. 

Collection and Use of Personal Information

• to enable you to access and use our Site, associated applications and associated social media platforms;
• to contact and communicate with you;
• for internal record keeping and administrative purposes;
• for analytics, market research and business development, including to operate and improve our Site, associated applications and associated social media platforms;
• to run competitions and/or offer additional benefits to you;
• for advertising and marketing, including to send you promotional information about our products and services and information about third parties that we consider may be of interest to you;
• to comply with our legal obligations and resolve any disputes that we may have; and
• to consider your employment application.

How We Get It

Most of the time, it comes straight from you: filling in an enquiry form, subscribing to our updates, or having a conversation with one of our team,
whether that's over email, on the phone, or face to face at an event. Where we can, we'll let you know at the time why we're collecting your details. You'll find more on exactly how we handle that in our Consent Policy, available on request.

Why We Use It

We use your information to:
• Run our coaching, career advisory, and certification programs
• Process enrolments and payments
• Answer your questions and provide support
• Send you marketing where we have a proper basis to do so
• Meet our legal obligations, including under the Cyber Security Act 2024 and, where relevant, AML/CTF requirements

We won't use your information for something unrelated to why we collected it in the first place unless you've agreed to that, or the new purpose is closely related and something you'd reasonably expect.

Who We Share It With

We sometimes need to pass information on to:
• Certification bodies or accrediting organisations, where relevant to your enrolment
• The IT, hosting, and payment providers who keep our systems running
• Our lawyers or accountants, when we need their advice
• Regulators or law enforcement, if we're legally required to

Marketing

If you're receiving marketing emails or texts from us, it's because you've either told us that's okay, or the context in which we met makes it reasonable to assume you wouldn't mind hearing from us. Either way, every message we send gives you an easy way to opt out, and you're always welcome to just tell us to stop.
This is what the Spam Act 2003 (Cth) actually requires of us, and we take it as a floor, not a technicality: consent to send you the message in the first place, clear identification of who we are in every message, and a working unsubscribe link that we act on promptly, not eventually.

Cyber Security

We take the security of the information you share with us seriously. We maintain reasonable technical and organisational safeguards, including access controls and multi-factor authentication on key systems, and we have a documented plan for responding if a cyber incident occurs, consistent with our obligations under the Cyber Security Act 2024 (Cth).

How Long We Keep Your Information

We keep personal information for as long as we reasonably need it for the purpose we collected it, and no longer. For most enrolment and coaching records it will be mean five years, aligned with the typical re-certification cycle for our courses. After which we securely destroy or de-identify the information, unless we're required to keep it longer for legal, tax, or regulatory reasons.

Cookies and Web Analytics

Our website uses basic analytics cookies to understand how visitors use the site like which pages are viewed and general browser information. We rely on this to improve the website, not to build individual profiles for advertising. Most browsers let you block or delete cookies through their settings if you'd prefer not to be tracked this way; doing so won't stop you using the site, though somefeatures may work a little differently.

Keeping Your Information Safe

We take reasonable steps to protect your information from being misused, lost, or accessed by people who shouldn't have it. That includes things like access controls, multi-factor authentication on our key systems, and a plan for responding if something does go wrong. 

How We Treat Personal Information That Is Also Sensitive Information

Sensitive information is a subset of personal information that is given a higher level of protection under the Australian Privacy Principles. Sensitive information means information relating to your racial or ethnic origin, political opinions, religion, trade union or other professional associations or memberships, philosophical beliefs, sexual orientation or practices, criminal records, health information or biometric information.

We only collect, hold, use and disclose sensitive information for the following purposes:

• any purposes you consent to;
• the primary purpose for which it is collected;
• secondary purposes that are directly related to the primary purpose for which it was collected, including disclosure to the above listed third parties as reasonably necessary to provide our services to you;
• to contact emergency services, or to speak with your family, partner or support person where we reasonably believe there is a serious risk to the life, health or safety of you or another person and it is impracticable for us to obtain your consent; and
• if otherwise required or authorised by law.

Our Site may contain links to other websites. We do not have any control over those websites and we are not responsible for the protection and privacy of any personal information which you provide whilst visiting those websites. Those websites are not governed by this Privacy Policy. 

Your Rights and Controlling Your Personal Information

Choice and consent: Please read this Privacy Policy carefully. By providing personal information to us, you understand we will collect, hold, use and disclose your personal information in accordance with this Privacy Policy. You do not have to provide personal information to us, however, if you do not, it may affect your use of this Site or the products and/or services offered on or through it.

Information from third parties:If we receive personal information about you from a third party, we will protect it as set out in this Privacy Policy. If you are a third party providing personal information about somebody else, you represent and warrant that you have such person’s consent to provide the personal information to us.

Restrict:You may choose to restrict the collection or use of your personal information. If you have previously agreed to us using your personal information for direct marketing purposes, you may change your mind at any time by contacting us using the details below.

Access:You may request details of the personal information that we hold about you. An administrative fee may be payable for the provision of such information. In certain circumstances, as set out in the Privacy Act 1988 (Cth), we may refuse to provide you with personal information that we hold about you.

Correction:If you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact us using the details below. We will take reasonable steps to correct any information found to be inaccurate, incomplete, misleading or out of date.

Complaints: If you believe that we have breached the Australian Privacy Principles and wish to make a complaint, please contact us using the details below and provide us with full details of the alleged breach. We will promptly investigate your complaint and respond to you, in writing, setting out the outcome of our investigation and the steps we will take to deal with your complaint. If you're still not satisfied, you can take it to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.

Amendments & Updates

We'll update this Policy from time to time as our practices or the law changes. We recommend you check our Site regularly to ensure you are aware of our current Privacy Policy.  This version is scheduled for review by November 2026, ahead of new automated decision-making transparency requirements commencing in December. If we're using automated tools such as CRM lead scoring by then, this Policy will be updated to disclose that. You'll always find the current version on our website, dated above.
